LAW 5403 - Labor Law Credit(s): 3 This course involves study of the National Labor Relations Act (NLRA), regulations under the NLRA, decisions of the National Labor Relations Board, court decisions, and other law governing employee representation and collective
bargaining in the private sector. Although the course focuses on union representation of employees and the process of collective bargaining, it also considers the application of section 7 of the NLRA to non-union workplaces (the right of employees to engage in protected concerted activity for mutualaid or protection). The course examines forces—economic, social, political, and legal—that influence and shape modern labor relations. It explores the role of organized labor in a freeenterprise democracy. Students will be asked to consider the fit of the NLRA within the larger body of workplace law that now exists in the nation. The course considers the roles of the NLRB, the General Counsel, the regional offices of the NLRB, and the administrative law judges and the interaction between the NLRR and the courts. The course also will consider the ramifications of the frequent changes in NLRB policy and law resulting from shifts in political power.
